These Terms and Conditions govern your use of the ViralHour website and the educational content, workshops, coaching, mentorship, communities, and other services offered by ViralHour LLC ("ViralHour," "we," "us," or "our"). By accessing our services or making a purchase, you agree to these terms. If you do not agree, do not use the services.

1. Eligibility and account information

You must be legally able to enter into a binding agreement to purchase our services. You agree to provide accurate contact, account, and payment information and keep it current. You are responsible for protecting your login credentials and for activity you authorize through your account. Notify us promptly if you believe your account has been used without permission.

2. Educational services and results

ViralHour provides education and mentorship related to content creation, affiliate marketing, and TikTok Shop strategies. Our materials are for educational and informational purposes and are not legal, tax, investment, or other professional advice. You are responsible for your own business decisions, content, disclosures, and compliance with applicable laws and platform rules.

We do not guarantee income, sales, audience growth, platform approval, or any particular result. Testimonials and examples reflect individual experiences and do not promise that you will achieve similar results. Outcomes depend on factors including your effort, skill, consistency, market conditions, and platform changes. Participation may involve costs and financial risk.

3. Purchases, access, and payment

The applicable offer or checkout page describes the price, included services, access period, payment schedule, and any other purchase-specific conditions. Review these details before purchasing. You authorize charges you expressly agree to at checkout, including any disclosed taxes. A payment plan does not by itself create a month-to-month subscription or a right to cancel remaining payments.

If an offer includes a recurring subscription, its renewal frequency, price, and cancellation process must be disclosed before you subscribe. Manage cancellation through the platform where you subscribed, or contact us for assistance. Any applicable refund, cancellation, rescheduling, or guarantee terms are those disclosed for your purchase and any rights required by law. These terms do not establish a blanket no-refund policy or limit mandatory consumer rights.

Specific written terms you accept for a program or purchase control over these general terms if they conflict on that subject. Changes to future offers do not retroactively change an accepted purchase agreement.

4. Workshops, coaching, and community participation

You are responsible for having the equipment, internet connection, and compatible software needed to access online services. Follow the scheduling and attendance instructions provided for your program. Treat participants and staff respectfully. Harassment, threats, discrimination, spam, deceptive promotion, and sharing another person's private information without permission are prohibited.

Do not record or redistribute private sessions or another participant's contributions without the necessary permission. We may restrict access for material violations of these terms or conduct that threatens the safety or security of the community, subject to applicable law and any purchase-specific rights.

5. Intellectual property

ViralHour's training materials, videos, templates, branding, and other original content are owned by ViralHour or its licensors. Your purchase grants access for your own use within the scope of the applicable offer; it does not transfer ownership. You may apply what you learn to your own content and business. You may not resell, publicly distribute, sublicense, or share restricted course materials or account access without written permission, except where permitted by law.

You retain ownership of content you submit. You grant us permission to use that content only as reasonably needed to provide the services you requested, such as reviewing a submission or displaying a community post to its intended audience. Any separate use of your name, image, or testimonial for marketing requires appropriate permission.

6. Acceptable use

Do not use the services for unlawful or fraudulent purposes, infringe intellectual property or privacy rights, introduce malicious software, attempt unauthorized access, or disrupt the services. You are responsible for ensuring you have the rights needed for content you upload or share.

7. Third-party platforms

Our services may use or link to third-party platforms for payments, community access, meetings, or other functions. Those providers have their own terms and privacy practices. ViralHour is not affiliated with, endorsed by, or sponsored by TikTok, ByteDance, Meta, Facebook, Instagram, or other social media platforms unless expressly stated. We do not control their policies, availability, algorithms, or account decisions and cannot guarantee continued access to any third-party feature or program.

8. SMS and email communications

If you separately opt in to ViralHour text messages, you may receive messages about the topics described at signup, such as workshop reminders, appointment updates, account support, and, if you consent to marketing, offers and promotions. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply. Consent to marketing texts is not a condition of purchase. Agreeing to these terms alone does not constitute consent to receive marketing messages.

You can opt out of text messages by replying STOP. You may receive a final message confirming your opt-out. For assistance, reply HELP or email brooke@viralhour.com. Carriers are not liable for delayed or undelivered messages. Provide a number you are authorized to use and notify us if it changes. You can unsubscribe from promotional emails using the unsubscribe link in those emails; necessary service communications may continue.

9. Privacy

Our Privacy Policy explains how we collect, use, and disclose personal information. Please review it before using the services. It controls in the event of a conflict concerning the handling of personal information.

10. Availability and limitations

We aim to provide useful, reliable services, but do not promise that the website or third-party systems will always be uninterrupted, error-free, or available. To the extent permitted by law, general website content is provided "as is" and "as available." This does not override express commitments made in your purchase agreement or warranties and rights that cannot legally be excluded.

To the extent permitted by applicable law, ViralHour is not liable for indirect or consequential losses arising from use of the services, including lost profits or business opportunities. Nothing in these terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot legally be excluded or limited.

11. Changes and general provisions

We may update these terms by posting a revised version with a new date. Changes apply prospectively, and we will provide additional notice or seek agreement when required by law. If a provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision does not waive our right to enforce it later. Nothing in these terms removes protections or remedies you have under applicable consumer law.
